In consideration of being allowed to enter the play area and/or participate in any party and/or program at Your 911 Shop LLC, DBA "The Cabin on 221“, the undersigned, on his or her behalf, and on the behalf of the participant(s) identified above, acknowledges, appreciates and agrees to the following conditions:

1.Legal Representative. I represent that I am the parent or legal guardian of the participant(s) named below, or I have obtained permission from the parent/legal guardian of the participant(s) named below to execute this agreement on their behalf. I agree that the participant(s) named below and I shall comply with all stated and customary terms, posted safety signs, rules, and verbal instructions as conditions for participation in any party and/or program at The Cabin on 221. In addition, if I observe any hazard during our participation, I will bring it to the attention of the nearest employee or official immediately. I understand that I am responsible for my child’s safety and behavior at all times each visit.

2. Agreement to Follow Directions. I agree, on behalf of any minor on which I am responsible, to observe and obey all posted rules and warnings, and further agree to follow any oral instructions or directions given by any employee, representative or agent of The Cabin on 221.

3. ASSUMPTION OF RISK AND INDEMNIFICATION. FOR AND IN CONSIDERATION OF THE USE OF THE CABIN ON 221 FACILITY, PLUS OTHER GOOD AND SUFFICIENT CONSIDERATION, THE RECEIPT AND SUFFICIENCY OF WHICH IS HEREBY ACKNOWLEDGED, We, the undersigned here WAIVE, all rights, claims, actions and/or causes of action for damages, losses or injury to persons or property, liabilities, cost, and expenses and hereby agree to indemnify, defend, and hold harmless The Cabin on 221, its members, officers, employees, agents, contractors from and against any and all claims, actions, and/or causes of action for damages, losses, or injury to persons or property, liabilities, cost, and expenses (including without limitation reasonable legal, attorney’s fees, and other expenses). I understand that there is inherent risk with using The Cabin on 221 Facilities and that participation may cause harm or injuries. By this waiver and release, I assume any risk and take full responsibility and warranty of any and all claims of personal injury and damages. I understand that I am signing this of my own free will in order to use The Cabin on 221’s Facility.

4. Fees. I agree to pay for all damages to the facilities of The Cabin on 221 caused by any negligent, reckless, or willful actions by me or my family.

5. Applicable Law. Any legal or equitable claim that may arise from participation in the above shall be resolved under South Carolina Law in a Court of Competent Jurisdiction in Laurens County.

6. Legal Fees. In any litigation, or other proceeding by which one party seeks to enforce its rights under this Agreement or sees a declaration of any rights or obligations under this Agreement, the prevailing party shall be awarded its reasonable attorney fees and costs, and expenses incurred.

7. Entire Agreement. This agreement constitutes the entire Agreement between the parties.

I HAVE READ THIS DOCUMENT AND UNDERSTAND IT. I FURTHER UNDERSTAND THAT BY SIGNING THIS WAIVER AND RELEASE, I VOLUNTARILY SURRENDER CERTAIN LEGAL RIGHTS.
